Are you considering an adoption in Colorado?
If you’re considering to adopt a child, its very important to know the guidelines and the legal process of doing it . Basically, there are two forms of adoption, “closed” and “open” adoption.
Newborn being adopted by a previously unrelated family and in which usually involves little or no future contact with the birth mother is what we called Closed adoption. While on the other hand, Open adoption is when the birth mother and the adoptive family agree to a high level of future contact, which may include visitation and phone calls.
The most common adoption to happen are Intra-family adoptions. It occurs when a parent/guardian becomes disabled or remarries or can no longer manage the responsibilities of parenthood. On the other way around, if a family member has been more involved in a child’s life than their parents, they may decide to seek custody and visitation rights, as opposed to legal adoption.
These are some facts that you should know about Colorado Adoption
First, the child must become “available for adoption”, i.e. either the birth parent relinquishes his or her parental rights to the child, or the Court terminates their rights. Once that takes place, the child may be legally adopted by a new family.
If you are considering private adoption, it is important to make your attorney aware of any promises or commitments made to the birth parent, including payment of specific medical bills and expenses. With a private adoption, it is tempting to draw up a contract with the birth mother prior to the birth of the child, but this contract will not be legally enforceable. Colorado law will not allow a birth parent to terminate their parental rights until the child is born.
